Please read these Terms of Service (“Terms”) carefully before using the Pacali mobile application and website (collectively, the “Service”) operated by Alex Kem (“we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
1. Medical Disclaimer
IMPORTANT: Pacali is not a medical device. It is not intended for the diagnosis, treatment, cure, or prevention of any medical condition. The content provided is for informational and general wellness purposes only. It is NOT intended to be a substitute for professional medical advice.
2. Accounts and Age Restriction
You must be at least 18 years of age to use this Service. You are responsible for maintaining the confidentiality of your account credentials. Accounts of underage users will be terminated.
3. Explicit Consent to Health Data Processing
By using the Service and providing health/biometric information, you explicitly consent to collection, storage, and processing as described in our Privacy Policy. You can withdraw consent at any time via app settings.
4. Subscriptions and Billing
- Free Trial: May be offered; cancel anytime during trial without charge.
- Auto-Renewal: Subscriptions auto-renew unless cancelled 24 hours before period end.
- Cancellation: Via device app store settings. Access continues until end of billing period.
- Refunds: Handled by respective app store (Apple or Google).
5. Intellectual Property
The Service and original content are the exclusive property of Alex Kem and licensors. Protected by copyright, trademark, and other applicable laws.
6. User Conduct and Prohibited Uses
You agree not to:
- Use the Service for illegal activities
- Harass or abuse other users
- Submit malicious code or interfere with the Service
- Impersonate others or gain unauthorized access
- Scrape or copy content without authorization
7. User Generated Content & Data Accuracy
You grant us a worldwide, non-exclusive, royalty-free license to use submitted content in connection with the Service. You retain all rights to your content. You are solely responsible for the accuracy of data you submit.
8. Third-Party Services
The Service may integrate with cloud storage, AI recognition, analytics, and payment processors. You acknowledge that data may be transferred to these third parties in accordance with their privacy policies.
9. Disclaimer of Warranties and Limitation of Liability
Service is provided “AS IS” and “AS AVAILABLE.” We do not guarantee AI recognition accuracy. Nutritional information is estimated. We are not liable for health outcomes. Alex Kem is not liable for indirect, incidental, special, consequential, or punitive damages.
10. Termination and Account Suspension
We may terminate or suspend accounts immediately for Terms violations. You can delete your account at any time via app settings.
11. Indemnification
You agree to indemnify and hold harmless Pacali, Alex Kem, and affiliates from any claims arising from your use of the Service or violation of these Terms.
12. Updates and Modifications
We may modify these Terms at any time. Material changes will be communicated with 30 days' notice. Continued use of the Service constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of Germany.
